Route Rescue Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Route Rescue, including the mobile application, game servers, accounts, purchases, events, websites, support, and related services (together, the “Service”).

The Service is provided by Bytevia Limited, a company registered in England and Wales under company number 17135228, with its registered office at Suite 10693, 5 Brayford Square, London, E1 0SG, United Kingdom (“Bytevia,” “we,” “us,” or “our”).

Please read these Terms and our Privacy Policy before using the Service.

1. Acceptance of these Terms

By downloading, accessing, creating an account for, making a purchase in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf where required by law.

Additional terms presented in the Service or by Apple, Google, an app store, or a payment provider may apply to specific purchases, subscriptions, promotions, beta features, or platforms. If those additional terms conflict with these Terms, the more specific terms govern the relevant feature to the extent required by law.

2. Eligibility, minimum age, and minors

Route Rescue is an Ages 16+ service and is intended for users aged 16 and over. In territories using PEGI, we intend to submit the game for a PEGI 16 classification. The final rating is assigned through the applicable PEGI/IARC or store questionnaire.

You must be at least 16 to use the Service. If the law where you live requires a higher minimum age, or requires a parent or legal guardian to agree to these Terms for you, that higher age or additional requirement applies. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian.

A parent or guardian who permits a minor aged 16 or 17 to use the Service is responsible for supervising that use, reviewing purchases and privacy settings, setting appropriate device and store controls, and helping the minor comply with these Terms.

3. App-store and platform terms

You may obtain Route Rescue through Apple’s App Store or Google Play. Your use of the store, device, payment system, and store account is governed by the applicable provider’s terms. The store provider may process payments, taxes, refunds, subscription management, and certain personal information independently from Bytevia.

You must comply with all applicable third-party terms, including wireless-data and internet-provider terms. You are responsible for device, internet, data, and carrier charges.

4. Licence to use the Service

Subject to these Terms, Bytevia grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to download and use Route Rescue on devices you own or control, solely for your personal, non-commercial entertainment.

You may not:

5. Accounts and account security

Route Rescue may automatically create an anonymous player account using a randomly generated identifier. You may be able to link the account to Apple or Google, use cloud saves, choose a display name and avatar, and access social or competitive features.

You agree to:

Accounts, player IDs, friend codes, and entitlements may not be sold, rented, traded, gifted, or transferred except through a transfer or account-merge feature expressly provided by us.

We may merge duplicate accounts, correct save conflicts, or restore entitlements where reasonably necessary. When cloud and local progress conflict, the Service may apply the conflict-resolution rules described in the app, which may preserve the higher progression or balance while preventing duplicate grants.

6. Gameplay, game rules, and live operations

Route Rescue includes campaign levels, challenges, events, missions, leaderboards, rewards, virtual items, and other content that may change over time.

You agree that:

We aim to describe offers and rewards accurately. If an obvious technical or pricing error occurs, we may correct it and provide any remedy required by law.

7. Virtual currency and virtual items

The Service may include virtual coins, gems, tickets, experience points, stars, boosters, trains, liveries, themes, avatars, passes, rewards, entitlements, and similar digital content (“Virtual Items”).

Virtual Items:

We may change the availability, name, appearance, function, or balance of Virtual Items. We will not intentionally remove paid digital content without a valid reason, and nothing in these Terms limits mandatory consumer rights relating to paid content.

Uninstalling the app, losing access to an unlinked account, or failing to sync an offline save may result in loss of locally stored progress. Linking an account and using available cloud-save or restore features can reduce this risk but does not guarantee that all data can always be recovered.

8. Purchases

Digital purchases are offered through Apple’s App Store or Google Play and are billed to your store account. Prices, currencies, taxes, and payment methods are displayed by the store before purchase.

Purchases may include consumable currency packs, bundles, season access, subscriptions, and other Virtual Items. You authorise the applicable store to charge the displayed amount and any applicable taxes.

Route Rescue may offer randomised Virtual Items or rewards, including chests, through gameplay, paid season-pass tiers, direct purchases, bundles, advertisements, or virtual currency. Where an offer involves a random outcome:

The store, not Bytevia, normally handles payment credentials and refund processing. Refund eligibility is governed by applicable law and the store’s policies. A refund, reversal, chargeback, or failed payment may result in removal of the associated Virtual Items or benefits. If a refund creates a negative or inconsistent virtual balance, we may restrict spending or correct the account while the matter is resolved.

You are responsible for reviewing purchase confirmations and enabling device or store purchase controls, especially when a minor can access the device.

9. VIP subscriptions

Where offered, VIP is an auto-renewing monthly or yearly subscription. The exact price, billing period, trial (if any), and included benefits are shown on the purchase screen before you subscribe.

Unless cancelled, the subscription automatically renews at the price displayed by Apple or Google for the next billing period. Your store account is charged according to the store’s subscription terms. You can manage or cancel the subscription in your Apple App Store or Google Play subscription settings. Deleting the app or your Route Rescue account does not automatically cancel a store subscription.

Cancellation stops future renewal but normally does not provide a refund for the current billing period. VIP benefits continue until the paid period ends, except where a refund, chargeback, fraud, or store action requires earlier removal.

VIP benefits may include bonuses, cosmetics, ad-related benefits, or other features described on the purchase screen. Some one-time welcome items may remain after the subscription ends, while ongoing benefits end with the entitlement. The current in-app description controls the specific benefits included in an offer.

If a free trial is offered, it converts to a paid subscription unless cancelled within the period stated by the store. Trial eligibility is determined by the store and may be limited.

10. Season passes and time-limited content

A premium season pass, where offered, applies only to the season identified at purchase. It is a time-limited, repurchasable digital item and does not provide permanent access to premium tracks in future seasons.

Season progress, premium eligibility, claim deadlines, the season end time, and every paid-track reward are shown in the Service. Paid-track rewards are fixed rather than random. Unless required otherwise by law or expressly stated in the offer, unclaimed season rewards may expire when the season ends. A delay in purchasing the pass does not extend the season.

11. Advertising

The Service may display rewarded, interstitial, banner, app-open, contextual, or personalised advertising, subject to your location, privacy choices, age treatment, eligibility, and any ad-removal benefit.

Rewarded ads are optional offers in which a stated in-game reward is provided after successful completion and verification of an eligible ad. A reward may be withheld if the ad is not completed, verification fails, a daily limit applies, the placement is disabled, or fraud is detected.

The scope of any “no ads” or VIP benefit is the scope stated on the purchase screen. Certain optional rewarded placements, house promotions, service messages, or sponsored content may be treated separately if clearly disclosed.

Third-party advertising is provided by external networks. We are not responsible for the content, products, or practices of an advertiser, although you may report inappropriate ads to us or through the ad controls provided.

12. Profiles, names, friends, and leaderboards

Profile and social features may allow you to choose a display name, share a friend code, add friends, and participate in leaderboards.

You must not use a name, avatar, or other profile content that:

We may filter, reject, reset, hide, or remove profile content and may restrict social features where reasonably necessary. Leaderboard scores may be delayed, recalculated, removed, or reversed following validation, correction, refund, fraud, or enforcement action.

Friend codes are not a platform social graph. Share them only with people you intend to connect with. We may impose friend limits and remove inactive, abusive, or invalid connections.

13. Acceptable use and fair play

You must not:

If you discover a security issue or exploit, report it privately to routerescue@bytevia.app and do not use it to gain an advantage or disclose it in a way that creates harm.

14. Updates, availability, and changes

We may update the Service automatically or require an update to continue using online features. Updates may add, change, or remove features, content, compatibility, or technical requirements.

We do not promise that the Service, a particular feature, event, server, item, offer, or platform version will always be available. We may suspend or discontinue all or part of the Service for maintenance, security, legal, commercial, or technical reasons. Where reasonably practical and legally required, we will give notice of material discontinuation affecting paid ongoing services.

The Service may contain beta, preview, or experimental features. These may be less reliable and may change or end without notice.

15. Intellectual property

The Service and its related software, source code, artwork, graphics, designs, characters, fictional maps, audio, text, user interfaces, databases, and other content are owned by or licensed to Bytevia Limited and are protected by applicable intellectual-property laws.

These Terms grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service for your own non-commercial entertainment. They do not transfer ownership of the Service or any related intellectual property to you.

You may not copy, modify, distribute, sell, license, publicly display, reverse engineer, or create derivative works from the Service except where these Terms or applicable law expressly permit it.

You retain ownership of any pre-existing rights contained in feedback or suggestions you provide. By submitting feedback, you grant Bytevia Limited a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free licence to use and develop that feedback without payment to you.

16. Third-party services and links

The Service uses or connects to third-party services, including Apple, Google, RevenueCat, AdMob, Google Analytics for Firebase, Firebase Cloud Messaging, Sentry, hosting providers, and notification providers. Their services may be governed by separate terms and privacy policies.

We may link to third-party websites, advertisements, or content. We do not control and are not responsible for third-party services, availability, security, content, or transactions. Access them at your own discretion and review their terms.

17. Suspension and termination

You may stop using the Service at any time. Where available, you may request account deletion through the app or by contacting us. Deleting an account does not automatically cancel an Apple or Google subscription.

We may warn, restrict, suspend, or terminate access, remove leaderboard entries, reverse invalid rewards, or delete an account where we reasonably believe that:

Where appropriate, we may provide the reason and an opportunity to appeal by contacting support. We may act immediately where necessary to prevent harm, fraud, abuse, or legal exposure.

On termination, the licence granted under these Terms ends. Sections that by their nature should survive—including intellectual property, payment obligations, disclaimers, liability limitations, governing law, and dispute terms—continue to apply.

18. Privacy

Our collection and use of personal information is described in the Route Rescue Privacy Policy. By using the Service, you acknowledge that information will be processed as described there, subject to your rights and choices.

19. Disclaimers

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Subject to those rights, the Service is provided on an “as available” basis. We do not guarantee that it will be uninterrupted, error-free, secure, compatible with every device, or free from data loss. Game simulations, virtual transport systems, incidents, and terminology are fictional or simplified and are not professional transport, safety, engineering, financial, or emergency advice.

We are not responsible for failures caused by your device, operating system, internet connection, app store, third-party service, unsupported modification, or events outside our reasonable control, except where applicable law provides otherwise.

20. Limitation of liability

Nothing in these Terms limits or excludes liability for:

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business loss arising from personal use of the Service, or for damage caused by your breach, unauthorised modification, or failure to follow reasonable instructions.

To the maximum extent permitted by law, Bytevia’s total liability arising from the Service during any twelve-month period will not exceed the greater of: (a) the amount you paid to Bytevia through the Service during that period; or (b) £50. This cap does not apply where it would be unlawful or where the preceding paragraph requires a different result.

21. Events outside our control

We are not liable for delay or failure caused by events outside our reasonable control, such as internet or cloud outages, app-store failures, cyberattacks despite reasonable safeguards, natural disasters, governmental actions, labour disputes, or failures of third-party networks. We will take reasonable steps to reduce disruption where practicable.

22. Changes to these Terms

We may update these Terms to reflect changes to law, the Service, business practices, or security requirements. We will post the updated Terms with a new date and provide additional notice where required.

If a change materially disadvantages you in relation to an ongoing paid service, we will provide any notice or remedy required by applicable law. Continuing to use the Service after the effective date of an update constitutes acceptance where permitted by law. If you do not agree, you must stop using the Service and may request account deletion.

23. Governing law and disputes

These Terms are governed by the laws of England and Wales, without depriving you of mandatory consumer protections under the law of the country where you live.

If you are a consumer, you may bring proceedings in the courts that have jurisdiction under applicable consumer law, including the courts of your home country where required. Otherwise, the courts of England and Wales have exclusive jurisdiction.

24. General terms

If any provision is found unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a reorganisation, financing, merger, acquisition, or transfer of the Service, provided your mandatory rights are not reduced.

These Terms, the Privacy Policy, and any specific offer terms form the agreement between you and Bytevia concerning the Service and replace prior discussions about the same subject, except that they do not exclude liability for statements that cannot legally be excluded.

25. Apple-specific terms

If you downloaded Route Rescue from Apple’s App Store, the following applies in addition to the other Terms:

  1. These Terms are between you and Bytevia, not Apple. Bytevia, not Apple, is responsible for the Service and its content.
  2. The licence is limited to a non-transferable licence to use Route Rescue on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and any applicable Family Sharing or volume-purchase rules.
  3. Apple has no obligation to provide maintenance or support for Route Rescue. Contact Bytevia using the details below.
  4. To the extent any applicable warranty is not effectively disclaimed, you may notify Apple, and Apple may refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding Route Rescue.
  5. Bytevia, not Apple, is responsible for addressing claims relating to the Service, including product-liability claims, legal or regulatory claims, and consumer-protection claims.
  6. If a third party claims that Route Rescue or your possession and use of it infringes intellectual-property rights, Bytevia, not Apple, is responsible for investigation, defence, settlement, and discharge of the claim.
  7. You represent that you are not located in a country subject to a United States Government embargo and are not listed on a United States Government prohibited or restricted-party list.
  8. You must comply with applicable third-party terms when using Route Rescue.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you after you accept these Terms.
